The new agreements for Nintendo accounts changed before the Switch 2 release.

In UK case they can remove your digital license.
The agreement for UK accounts now states digital products are "licensed only for personal and non-commercial use", and that any "unauthorised use of a Digital Product may result in the Digital Product becoming unusable".
US goes a bit more deep saying they can brink your console.
his differs slightly from the US, which states: "You acknowledge that if you fail to comply with the foregoing restrictions Nintendo may render the Nintendo Account Services and/or the applicable Nintendo device permanently unusable in whole or in part."

 
Nintendo is not playing around this generation. They understand the threat PC emulation, PC piracy and Switch piracy pose and they are doing everything to prevent it from happening again.
They're gonna learn the hard way that they can't do anything about it lol

Well TBH with the speed at which the Chinese game industry is developing maybe no one there will care about Nintendo games in 5 years
 
I thought both Nintendo and Sony always did this when they detected you were using a hacked firmware or some other trick to run unauthorized apps in their consoles.
 
I dont use online mode for Nintendo games anyway. Im not paying $60 for Pikmin 3 when I bought it brand new on Wii U for much less.

Nintendo can suck my @ss for $80’s too. Im not buying there games brand new again. 2nd hand for me, ebay and avforums like

First of all that's cope because people keep saying it and yet zero emulators from Russia or China. And second you want to avoid the law? Alright we can do it too. How about we send someone to your house and break your legs? Still wanna make emulators? Don't think so.

More than emulators, these flash carts that people use to run pirated games in very old consoles are made by an Ukranian folk that due to war moved a few years ago to Spain, and then there are the Chinese equivalents / inferior copies of these flash carts. I knew about him when I started to develop my first Game Boy Color and Mega Drive games last year, these carts are very useful to test the games in real hardware. I don't know who made the Switch ones like Mig (not him) or where are they from.

There's a ton of super talented people in Russia/Ukraine/etc. regarding hacking and reverse engineering that don't give a fuck about copyright so yes, if not the full team of the Switch flash carts, a good portion of their team may be from there.

The emulators in general (not the Switch ones in particular) are a different thing, made by teams of people spread all around the world, typical from US and EU. Same goes with rom dumpers.

If purchase isn't ownership, piracy isn't stealing.

I know it's an unpopular opinion but those who stop peaceful protest with the wallet, make serious protest on the seven seas one inevitable.

I really believe piracy helps rebalance the industry and did so during the best years of gaming.

I understand the forums views on piracy and how it is illegal and stealing, I agree, it is. However, what these companies are doing is legally taking your money, which is fine, but then take it illegally using 'legal' loopholes. It needs to stop for the good of the industry.

Nintendo terms didn’t have any of that before… if Nintendo do that it could be straight sued.

Now they have it in the terms of service so while they can be sued it is a bit more trick lawsuit.

I don't know if it was mentioned explicitly in their terms of service, but both Sony and Nintendo banned consoles/accounts where they detected that were using unofficial stuff since the PS3/Wii generation (the first one with mainstream online).

Your console could not get brink with Wii… Nintendo never did that… what they banned was that Wii from the online services.

I do t think Sony could brink your PS3 either… they just banned that console from online services.

You could use your console normally to play physical media but digital games not anymore.
 
Today you pretty much don't own any digital games, you're just renting a license
Soon we're gonna be paying for hardware but it won't be ours, just a leasing

If you can't do whatever you want with it, then it's not yours
