So I've had a read and the NZ regulator's view is that:
Cloud gaming is a separate market
Foreclosure in cloud gaming is a possibility
Foreclosure in console gaming is a possibility, but less likely
They're inviting submissions on the matter, but it's highly affirming for normal humans. May reee writhe in hell.

Toiletseat/klobrille is a creep, and Reee have just run off another developer with their cringe defence of the acquisition. Chubigans posted in their thread showing that a plurality of developers thought acquisitions were bad for the industry based on a GDC poll, and the refuse there effectively called him and the developers polled trash humans.
So that's way more gamers, more developers, and more major regulators being against the deal than for it.
Now that's fucked up.

They could argue if MS is not restrained further there is a possibility of them closing over other jurisdictions where there is an appeal(UK) going on and concerns(new zealand) that have been found that need addressing, hopefully Australia strike next to add to that pile.
Even though I believe Microsoft are talking shit about closing over CMA, it could end up biting them in the ass with that bluff. Even if the admit they were never going to close over the CMA, the judge could do the sensible thing and grant the injunction just not to be culpable of what MS could do next.

It's great to see more people speaking up about the harmful aspects of Gamepass. Sure, there's always going to be astroturfers, shills, and fanboys who refuse to listen - but I'd like to think that reasonable people appreciate those different perspectives.
From my perspective, the combination of MS and a sub service (which encourages not owning games) was a disaster in the making from day one. The astroturfing surrounding it has been insufferable (best deal in gaming, developers love Gamepass, subscribers buy more games, etc. ) and it's been good to see all the lies being dismantled one by one.
