The whole list below would not even account for 5% of COD players in the future, while PS accounts for 40% of that playerbase. What a fucking ignorant ass.

The info got out that the 10 year "deal" is basically gives Activision 100% its revenue from games and DLCs sale. I don't know who in their right mind would think it is a good deal.

I don't know why FTC didn't bring that up, consider they are professional morons.

Personally i'm not holding my breath on this appeal going anywhere. The system is rotten to the core.

But it definitely is a good point to appeal on. The thing is her saying that it's not enough for the FTC to prove that it "may" harm competition is pretty much her conceding that's what they manged to do. Now if the court agrees that it "may" harm is enough then that might help the FTC.

Another thing she made the distinction between "may" and "will", so can't wriggle her way out of that by saying both can be taken as similar.

But again i'm not holding my breath.

You thought the PI had a "real" shot lol. PI always had a small shot to go through. Getting an emergency Stay at the 9th circuit is even harder. Judges just have to agree on 1 of Judge Corley key points, and then the emergency stay fails.

The point of appealing is to buy time to prevent ABK closing, the judge is corporate slave disregard all procedures, even make immature mistakes to please MS.
I don't think FTC winning the appeal here since they are professional clowns, but it would definitely help stalling the deal before deadline.

Ummm no? CMA and MS/ABK have all agreed to pause the CAT.

CMA/MS/ABK are working things out hence the pause.


That's not even half the story, but I'm aware that Xbox Evangelists are unable to think without marching orders:

The UK’s Competition and Markets Authority said on Wednesday that the companies could “choose to restructure” the takeover and it was “prepared to engage with them on this basis”, though it emphasised any fresh deal could trigger a new antitrust probe.

What the CMA said was, essentially, "if you want to restructure the deal we're willing to open a new investigation and re-analyse its market impact". The CAT hearing fell because Microsoft and ABK dropped out of it. Without them, there's no court case to be had.

Additionally, the timeline was as follows
  • CMA provided its provisional remedies, which included partial or complete divestiture of several businesses within ABK
  • MS were unwilling to divest parts of the business
  • CMA blocked the deal, and MS appealed to the CAT
Now, MS and ABK have decided to drop the appeal and stated they want to talk with the CMA
  • The CMA says that they need to revert to the current decision (prohibition), and that they will need to submit a new deal that satisfies their concerns, which includes partial or complete divestiture
  • Once MS and ABK agree to that new deal, a new probe will be launched by the CMA, which may or may not allow the deal to go through
I highly doubt the CMA will go back on their decision with anything but one of the divestiture options, and I believe that option would always need to go through shareholder approval. I'm also not confident that ABK shareholders are in agreement with the current deal premium, and may want a few extra dollars on top of it to reapprove.

This i the part that isn't clear to me, wouldn't that mean this new deal would have to go through the approval of all countries regulators again if it is substantially different? If not that basically suggests that MS can ringfence the UK and divest solely in that jurisdiction but not anywhere else.

Exactly what I was thinking they'll make a big song & dance about games developed by Japanese Devs / publishers (final fantasy obviously being the best example) & even go as far as say how much they hope they acquire a Japanese publisher like sega , while their beloved Microsoft & US government are attacking the Japanese for being Japanese & not selling out to the US
