The alleged Nintendo Switch modder who refused to shut down their business despite a warning from Mario maker Nintendo now appears to be taking the titan on in court without a lawyer.

As reported by Torrent Freak, Ryan Daly, the alleged owner of modding company Modded Hardware, has denied any wrongdoing in court — even that he owns and operates the business at all. Nintendo filed a lawsuit against Modded Hardware in July, alleging it "not only offers the hardware and firmware to create and play pirated games" but also provides "customers with copies of pirated Nintendo games."

"Typically, when a customer purchases a hacked console or the circumvention services, Defendant preinstalls on the console a portfolio of ready-to-play pirated games, including some of Nintendo’s most popular titles such as its Super Mario, The Legend of Zelda, and Metroid games," Nintendo's lawsuit claimed.
"Indeed, because pirated Nintendo Switch games cannot be used or created without a hacked console and related software and hardware, it is only because of products and services such as those sold by Defendant that illegal marketplaces distributing pirated games exist and thrive."

It always the same excuse…

I didn’t created the mod to be used to play pirated games.
I didn’t create the emulator to be used to play pirates games

But all always had the same goal in mind… play pirated games.

Nintendo needs to fuck up these guys badly.

I'm a PlayStation fan... I don't play Nintendo games since Nintendo 64.
I wish Sony do the same with emulation and PS modders 🤷‍♂️

Sony didn’t do the same probably due to them losing a lawsuit against emulators back in the early years.

Not a lawsuit, multiple lawsuits
Sony v Bleem and Sony v Connectix solidified the legality of emulators in the US.
Though, if this guy really was providing roms with his hacks, he's fucked lol

If I remember correctly these emulators checked the disc, no? Only original physical media could play on these emulators.

That played a big whole in the lawsuit.

Emulators today doesn’t care about running original media… they have no check or validation to block it like Bleem did.

Nobody today uses original media to use in emulation… that is basically illegal… and any emulator developer support of the use of dumped rom and even incentive it with tutorials.

I should say emulation should be legal and not even lawsuits couldn’t change that but there is no developer today that create legal emulation 🤷🏻‍♂️

Enjoy not being able to play games that you 'bought' because a corporation decides to shut them down, stop selling them, or bans them for reasons.

"But muh piracy". How does this personally affect you, though?
