The reason Lohan didn't win was that the picture the artwork was based on was of Kate Upton.

If Kate had sued, they would have lost if the contract for the shoot didn't include a full transfer of rights for the pictures taken.

If the picture they traced had been Lindsay Lohan, again, depending on the contract for the pic, they might still have won the suit.

The hilarious part was that chronic train wreck Lindsay Lohan sued because she didn't realize that it was clearly another celebrity they based the image on.
