Wait, hold up, these were all part of the record in the FTC hearings?

You mean to tell me that they had proof that Xbox's acquisition ambitions extended to taking over Nintendo and Valve, as well as proof those Bethesda games were definitely not hitting PS5 as opposed to Phil's claims that they were still "case by case"... but did nothing with that?

It was never going to be a fair case Microsoft has deep pockets & the judge was going to rule in their favour no matter what

The judge was clearly biased, and now we know just how bad it was.

The FTC has a real case for judicial misconduct with this coming out, and that may even be the purpose of the leak.

They did say they were intentionally holding back evidence for future proceedings. I just hope the lawyers they put up in the court are more organized and cohesive than during the hearing. They had good enough evidence there, but let the judge and people at Xbox on the stand take the lead too often.

Just wanted to point out that Jim Ryan was 100% right, Starfield being Xbox exclusive has not had a major impact.
How does it compare to the usual level of Bethesda jank, in terms of like game design? The ownus has always been on the game itself rather than MS' pomp and circumstance, hasn't it?

I suppose what I'm trying to ask is like... How's the game on its own merits, without MS'... expectations for it?

Of course. The judge was compromised and guaranteed to rule in MS favour. The FTC did have a chance to request a more impartial judge, so they were incompetent in that respect.

I wouldn't be surprised if the whole FTC trial was rigged to be "lost in court" from the beginning.

Did we forget that Xbox/Microsoft is an American company?

Why would the American Government/People sabotage their own economic growth?

Did you think it was a coincidence that the UK was the only one who pushed back because they are a sovereign land that doesn't have a conflict of interest with the situation?

The UK doesn't get affected economically by the deal, but the US economy sure does.

They weren’t incompetent. To get a judge replaced, you have to petition the judge themselves and it is up to them to decide whether to recuse themselves.

Telling a judge you want them to recuse themselves from your case due to possible bias pretty much guarantees that they won’t, and that they will not be very favorable to you in court after you’ve levelled that accusation, no matter how true it is.

The FTC took the only smart play, which is let the judge stay, then appeal on grounds of judicial bias or misconduct after they decide against you.

It was the judge's moral responsibility to recuse herself. If she wasn't stepping aside, it was for a reason. It also meant she wanted to put ethics to the side and do what she wanted to do (rule in favor of Microsoft).

Her mind was already made up. FTC accusing her wouldn't have done them any good anyway.
