You are correct, but it's still 3rd party, no gray area. We have heard of Sony devs helping out other non-Sony devs in the past already, never was there anyone mentioning those games to be 1st party.
Same as Microsoft devs going to help to make Baldurs Gate 3 work on their console.
That's why I have to laugh at people trying to make any arguments with MAU.
Each time I turn on my PC and my Steam client autostarts I count as an active user... yet I haven't bought or played a game on there for over 10 years.
It's also a bit of an ingenuous value, as even a long-running Sony fan not into GaaS and superheroes would have skipped the only 3 (of which 1 discontinued shortly after launch) 1st party titles they launched in the 2 years they are counting.

There is a difference between MLB and LEGO Horizon. The former is published by MLB, Horizon by PlayStation themselves. Why would PlayStation set up as publisher for Switch if they intended to do it for just one game?

They were already refunded when account-gate happened and the game was delisted in those countries.
They could have enforced the PSN link since then, but they didn't, so I doubt they will in the future.
