They would get sued if they can't present justification for a merger disqualification. It's their job to prove there's an actual justifiable problem, it's not on the purchasers to prove there is not.

They can't just block acquisitions because a purchaser isn't nice to them lol...

I'm not sure you understand how politics works. The deal is already under heavy scrutiny in the UK and now under heavy scrutiny in the EU for the same exact reasons. Not providing the requested information is not in their best interest. I get that they have lawyers, but the American corporate culture seems to have a lot of problems adjusting to the European / EU reality when doing business.

I can actually see the EU approving this deal with heavy concessions, and if MS doesn't accept or goes to court, the deal will fall through. Court proceedings in these types of deals take years.

Yeah no, that's not how it works, it's political. EU decides what they want in EU. And deal collapses globally if EU denies it, because a deal without EU wouldn't make sense for MS (EU is 440 million consumers).

Sueing them would take years and would probably lead to nothing, since EU decision will be explained in every way possible with all the documents needed.

It's not about "being nice to them", EU doesn't care about Microsoft or Sony. But like in a trial, you must provide every document to defend your position. And show the acquisition will be ultimately harmless to consumers (which is arguably wrong, because MS would definitely raise GP price drastically and lower quality on the long run if they ever got a monopoly, like they always did).

Not providing answers obviously doesn't help their case...

The EU will do as it's told if push comes to shove. All depends on how serious MS is about the acquisition. A few phone calls to the administration will get the EU in line no problem. I don't think that is currently necessary/required. I don't think the EU with the problems its facing right now would add an additional source of tension in economic releations with the U.S, considering the dependency they've pigeon holed themselves into by being feckless, bought out idiots. Considering that the EU is more or less a marionette of the U.S as currently staffed.... please...
