[private] for Nintendo of America Inc.

Please provide a detailed description of the original copyrighted work that has allegedly been infringed. If possible, include a URL to where it is posted online.

The Nintendo Switch console and video games contain technological protection measures (“TPMs”) that permit the Nintendo Switch console to interact only with legitimate Nintendo video game files. This process protects Nintendo’s copyright-protected video games, including but not limited to those covered by U.S. Copyright Registration numbers PA0002213509 (Super Mario Maker 2); PA0002233840 (Animal Crossing: New Horizons); PA0002213908 (Luigi’s Mansion 3); and PA0002028142 (The Legend of Zelda: Breath of the Wild) by preventing users from playing pirated copies of Nintendo’s video games on the Nintendo Switch console and by preventing users from unlawfully copying and playing Nintendo’s video games on unauthorized devices.

Do you claim to have any technological measures in place to control access to your copyrighted content? Please see our Complaints about Anti-Circumvention Technology if you are unsure.

Yes

What technological measures do you have in place and how do they effectively control access to your copyrighted material?

Nintendo embeds TPMs in both the Nintendo Switch console and video game files, including but not limited to encryption of the video game files which requires certain cryptographic keys, such as prod.keys, that are used to verify, access, and play each game played on the Nintendo Switch. The TPMs employ encryption as described in more detail below.
The Nintendo Switch console allows users either to play games on physical cartridges that are inserted into the console, or to play games digitally downloaded from Nintendo’s server. Both formats are protected by Nintendo’s TPMs, including encryption of its video games. When a game is started on the Nintendo Switch console the games are decrypted and verified using various Nintendo cryptographic keys so they may be played. Nintendo owns or exclusively controls numerous copyrights in software and games that are protected from unlawful access and copying by the operation of these TPMs. In their ordinary course of operation, the TPMs require the application of information and a process (as described above), with the authority of Nintendo, to gain access to Nintendo’s copyrighted works, and thus effectively control access to and copying of Nintendo’s copyrighted works.

How is the accused project designed to circumvent your technological protection measures?

The reported repositories offer and provide access to the yuzu emulator or code based on the yuzu emulator. The yuzu emulator is primarily designed to play Nintendo Switch games. Specifically, yuzu illegally circumvents Nintendo’s technological protection measures and runs illegal copies of Nintendo Switch games. Nintendo Switch games are encrypted using proprietary cryptographic keys (prod.keys) which protect against unauthorized access to and copying of the copyrighted games. During operation, yuzu necessarily uses unauthorized copies of these cryptographic keys to decrypt unauthorized copies of Nintendo Switch games, or ROMs, at or immediately before runtime without Nintendo’s authorization. Thus, yuzu is primarily designed to and unlawfully “circumvent a technological measure that effectively controls access to a work protected under” the DMCA. 17 U.S.C. § 1201(a)(1). Therefore distribution of yuzu constitutes unlawful “traffic[king] in a[] technology ... that ... is primarily designed or produced for the purpose of circumventing a technological measure....” in violation of Section 1201 of the DMCA. Have you searched for any forks of the allegedly infringing files or repositories? Each fork is a distinct repository and must be identified separately if you believe it is infringing and wish to have it taken down.

Yes. Based on the representative number of forks I have reviewed, I believe that all or most of the forks are infringing to the same extent as the parent repositories.

Is the work licensed under an open source license?

No

What would be the best solution for the alleged infringement?

Reported content must be removed

Do you have the alleged infringer’s contact information? If so, please provide it.

No, we do not have contact information.

I have a good faith belief that use of the copyrighted materials described above on the infringing web pages is not authorized by the copyright owner, or its agent, or the law.

I have taken fair use into consideration.

I swear, under penalty of perjury, that the information in this notification is accurate and that I am the copyright owner, or am authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed.

I have read and understand GitHub's Guide to Submitting a DMCA Takedown Notice.

So that we can get back to you, please provide either your telephone number or physical address.

Yikes, Nintendo isn't fucking around this time.

I wonder if they really see Switch emulation as a big threat to the Switch 2's backwards compatibility.
Can you imagine the massive fuck up if a Steam Deck 2, ROG Ally or Legion Go can play Switch 1 games better than Nintendo's own Switch 2?

On the one hand there is a company bending over and doing everything for the PC audience, on the other one, there is a company fighting with all forces to protect their exclusiveness.
Well one business is where the Japanese division gives the marching orders and another is where American and European divisions decide. Not surprising as being a cuck has always been a western thing

Now guess who is going to end up on top over time? The playbook Sony copied from Xbox has to be one of the most stupid moves in gaming in a long time.

What I find funny is that they just don't seem to realized how valuable their own position in gaming is and are just set into copying the stuff that didn't work at all for Xbox and Disney.

We already have an example of what happens when someone goes the path the former is walking on, no need for guesses.
Too bad Sony executive don't seem to follow up on where Xbox ended up and are just set on doing the same to PlayStation. Their loss, hopefully Nintendo will be able to steal a lot of market share from Sony and offer a decent substitute to PlayStation consoles in due time.

Sony will probably be happy to publish games on that platform when the time comes. They need to maximize profits after all, right? :ROFLMAO:

Sony would upload the emulator to their own website, as well as roms.

Nintendo looks scared. The switch 2 hardware must be as off the shelf as it gets and anemic AF.

I don't bother with current gen emulation anyway but they brought this on themselves. Do you want people to stop emulating, release better consoles.

Yeah this has been their regulat for ages. They don't play with tht stuff for good or for bad.
Yes, Nintendo has been always by far the most aggresive company regarding taking down rom websites, flashcart businesses, fan games, unlicensed merchandising, emulators of recent platforms, etc.

Regarding emulators, they don't give a fuck regarding emulating very old stuff like NES or GB, things they are no longer selling since a long time ago. But obviously, it's a different thing to emulate (pirate) the games they are currently selling, so negatively affecting their revenue/business.

Basically common sense, protecting their copyright.
