The FTC definitely should not have said that at the end of their statement. That may bite them later.
I would take Capcom games over ABK days just about every day of the week, but Capcom just isn't nearly as big.

it is nothing compared to ABK and you saying it is counter. no, it is not.
Might just be typical lawyer speak. I don't know anything about how these things work, but I would hope the FTC wouldn't be so dumb as to make an obvious mistake that jeopardizes the outcome.
Also, the judge making a ruling because they had that kind of personal hubris would be really kinda beyond the pale.

Email MS showed had Jim saying that he didn't think COD would be exclusive and that they'll be just fine if ABK goes through.
I don't think it's a big deal tbh.
He sent that email in 2022 in the early days of the merger announcement when things would not have been clear, and we don't know the context of the email either, is it just to reassure the rest of the company?
Once they started negotiations the reality of what MS will do set in.

Couple of things:
- Those comments could have been made before they tried to extort Sony as demonstrated to the CMA
- Jim Ryan is a fucking idiot
Welp this basically proves MS's statements of COD on Switch being easy-as-pie to do were a complete lie.
Yeah that's a pretty damning statement from Jim Ryan there. Somewhere I'm sure Brad Smith is smiling finding this out.
Well Jim Ryan is supposed to be a witness, right? Hope he can contextualize these statements once he's cross-examined.
