I'm not a lawyer at all, but this also seems so straightforward. From what I've read the language the judge used, and the language the actual standard calls for clearly mean different things. It's basic English understood by a small child.
Seems like it should be a slam dunk (and that the judge is a colossal idiot. Hey, idiots are in every single profession in the world even ones where you think being "smart" is required), but we all know how that can go.
Whats even more stupid about the American vs Japanese situation thats is going on is Japan approved the merger with the EU but yet that's being ignored. The politicians over here in the U.S are stupid.

Microsoft will never get a Japanese publisher. This a dream of Xbots and Master Racer. Hell Square Enix or Capcom would sell to Microsoft. If they would do they can register for insolvency. They would be dead so all their franchises would die.
I don't believe it will be anywhere near that simple for MS to scoop up a bunch of Japanese publishers like that, especially not Square, but I agree that Sony need to make some moves behind the scenes while MS are busy integrating ABK.
I could see Kojima going to xbox otherwse but thankfully he wants to be independent.
