They denied the emergency stay the FTC was seeking. It isn't a surprise (still disappointing though). The FTC can still appeal if it wants but MS may be able to close beforehand if the CMA pushes it through.
it makes no sense why it was denied. clearly we saw what they send it. it was clearly shown how judge made foul statements etc...

Denied again. The FTC is completely powerless. Microsoft is basically the government and the judges are on their side. Lina should leave at this point. They don't want the FTC to even investigate. Nothing. Just let it go through.



A grotesque perversion of the legal system. Literally everyone involved in this should be locked up for life. The damage to the reputation of US institutions is irreversible.

FTC vs Warner Communications

In determining whether to grant a preliminary injunction under section 13(b), a court must 1) determine the likelihood that the Commission will ultimately succeed on the merits and 2) balance the equities. Federal Trade Commission v. Simeon Management Corp., 532 F.2d 708, 713-14 (9th Cir. 1976). The denial of a motion for preliminary injunction will be reversed only if the district court abused its discretion or based its decision on an erroneous legal premise. American Motorcyclist Association v. Watt, 714 F.2d 962, 965 (9th Cir. 1983); Simeon Management Corp., 532 F.2d at 711.

It looks like the 9th circuit did not think the FTC would be likely to prove the merits of the case.

Or, the balance of equities couldn't be met. Actually this seems likely the cause of the denial to me as it seems to me that one party (Microsoft) would suffer irreparable harm if the injunction was granted, as the deadline for the deal would be breached.

Imo this looks it’s probably a done deal, it’s better to move on. Now gentlemen you know what will happen. The main drape for consolidation is about to open. The inevitable marriage is about to happen.

FTC Administrative court is still August 2nd, so MS and CMA can make a deal and close, if FTC by some miracle won that case then MS would have to sell off Acti. But seeing at how bad FTC lawyers were in the injuction trial, looks like MS will successfully be able to gobble up gaming.

Do you want to see Sony losing more close partners? You don’t get it Sony will need to protect their interests. You guys shouldn’t expect something like EA or TakeTwo. What I can see what Sony will do, they will acquire one or two Japanese pubs. This first one is obviously Square Enix (because of existing and strong synergies across the whole Sony Group Corporation). Next would be in a couple of years Capcom. They won’t acquire Take2 in full just an investment (shares), Sony will not pay $40B for them.

Gaf just became insufferable with cheerleaders of the deal shouting down PaintTinJr's comments, which are the only logical ones: either Bobby extends the deal on July 18th or MS takes an L, with the small victory of having set an awful precedent in the USA to make it easier for other corpos to walk all over regulators.

It is best to go big. Capcom and SE are Japanese companies. So they should be protected. Plus we can count major Japanese on one hand. Japanese gov will not let foreign companies gobble them up.
Yes they will. Square Enix has a lot of IP from A to AAA.

You rather Sony not buy them and lose those games?
It is best to invest in SE rather than buy them. What if Sony loses T2 or EA in coming months? Do you think Sony will be able to compete against MS output when they have Zenimax plus + ABK + (EA or T2). Even with Capcom and SE they will come very short.
