imo the likeness is totally beyond dispute. it's not just bugs in space. it has exactly the same slapstick fascist comedy element too. not to say i want them to be sued, just that the standards make no sense to me.

Unless they are specifically using names or designs from what they are ripping off, it is considered legally distinct and is therefore lawsuit-proof. The precedent was established LONG ago, and has held up many times.
Shit, Nintendo ended up having to buy the rights to Super Horn Brothers to suppress it, as it was legally a parody and they weren't able to sue over it.

Yes I am aware. Tht is my point it would set a different precedent, one courts would not want and open a can of worms. Although not impossible because cases have gone to court after a precedent was set years ago and have won and have thrown the legal world upside down but highly unlikely.
IP infringement is hard to win unless there is a DIRECT swipe of an identifiable element. Even blatant stuff like the millions of Alien ripoffs that even tried to imitate Giger's creature design were safe in law. Software-wise, look-and-feel is not considered protected either. The degree to which you can ape a successful product without crossing any lines is actually pretty crazy in the US system.
