You're misunderstanding the argument. It doesn't matter if emulators are used for copyright infringement 99% of the time. Emulators are not copyright infringement. Emulators don't facilitate copyright infringement. Yuzu developers don't distribute anything owned by Nintendo. They ought to be totally above board distributing those key files too, but they've been extra cautious.

Regardless of what anyone here says is 'fine' or 'they would do' or 'is legal', Nintendo doesn't want you doing any of this and fights against it by all means. Before 2018 they were also hostile toward any streaming of their games:my question is do you consider it piracy if you buy the game digitally on the 3DS eShop and use an emulator to capture footage from the game? I bought Resident Evil Mercenaries 3D on the 3DS eShop back in 2015 but had to use the citra emulator in 2022 to capture footage from it as buying a modded 3DS for capture purposes was kinda pricy especially for just a little bit of footage.
Also would emulating a game that is no longer sold considered piracy to you guys? I really want to try Metal gear Solid Twin Snake's but the price tag for a used copy on it is pretty pricy and doesn't even give any money to the creator's. I probably won't have any time to play Twin Snakes anyway now since I'm kinda busy on FF7 Rebirth
